Scale-Up Visa – Key Points

The Home Secretary, Priti Patel has just announced a new Visa Category which she named as ‘The Scale-Up Visa’, aiming to “Attract the skilled talent to our economy needs”. The route will be open to people who have a job offer from a “Scale-Up” Company.

What is a “Scale-Up” Company?

A Scale-Up company is one that;

a). Is registered with Companies House in the UK
b). Has experienced a 20%+ annual growth rate in turnover Or
c). Has accomplished a 20%+ annual growth rate in the numbers of their employees over the past three years.
d). The Company must have employed at least 10 employees at the beginning of the three-year period.

What are the eligibility requirements for the Scale-Up Visa?

The Secretary of State will be introducing detailed requirements for this category in due course. So far, limited information has been published on the eligibility criteria as follows:

1). There will be a basic qualification requirement to meet
2). There will be a salary threshold to be offered to the Applicant
3). Applicant’s will need to prove their competence in the English language
4). A minimum level of education will be required
5). There is a likelihood that a financial maintenance requirements (as in the other PBS categories) will be required
6). The fundamental point of understanding is that the Scale-up visa is a sponsored work visa under the Points-based System.

Will you be able to extend a Scale-Up Visa?

Information published so far states that holders of the Scale-Up Visa will be able to extend this for a maximum duration of 5 years. The likelihood is that the applicant would need to initially apply for the Scale-up visa and look to extend this thereafter.

Will you be qualified for settlement on basis of the Scale-Up Visa?

Yes. After 5 years Applicant’s become eligible to apply for settlement in the UK. Potentially, applicant’s will also be eligible for British Citizenship.

Can you bring your family to the UK on a Scale-Up Visa?

Although the Secretary of State has not confirmed this, there is a possibility that in line with similar Visa’s, this route may allow Applicant’s to bring their family to the UK.

How much will be the fees for the Scale-up visa?

The government will announce the fees and the Immigration Health Surcharges alongside the detailed policy guidance.
